Special Education & Section 504 Litigation and Advocacy

 

A child’s education plan often determines whether the rest of life can stay stable. When schools rely on discipline instead of supports, or when services do not match a child’s needs, families and foster parents are left to manage the fallout at home, in court, and in the community. Our firm represents caregivers in special education (IDEA) and Section 504 matters to ensure that children receive meaningful, enforceable support at school.

We advocate for appropriate Functional Behavior Assessments (FBA) and effective Behavior Intervention Plans (BIP), help with eligibility, discipline and manifestation hearings, mediation, and due process, and coordinate school services with juvenile court and adoption matters.

Adoptions and Termination of Parental Rights

 

Adoption cases are about far more than paperwork—they are about a child’s identity, attachments, education, and future stability. We represent families, foster parents, and relatives in uncontested and contested adoptions and in termination of parental rights (TPR) proceedings.

We handle TPR trials, foster and kinship adoptions, step-parent adoptions, intervention in juvenile cases, and appeals of TPR decisions. We represent LGBTQ parents and youth with respect and affirming advocacy.


For Foster Parents: Practical Guidance

 

Foster parents are often the adults who know a child best—the routines that work, the school struggles, the medical needs, and the relationships that help the child feel safe. Yet foster parents can feel like their voices are not fully heard in court or agency decisions. Our firm helps foster parents understand their role and present clear, meaningful information in the places where decisions are made.

When a child has been placed in your home for nine (9) months or more, Tennessee law allows you to appear and actively participate in permanency and dispositional hearings regarding the child’s best interests. We represent foster parents so that they are able to present this evidence to the court in a clear, organized, and effective way and to ensure that their opinion regarding the child’s best interest is considered. 



Juvenile Delinquency

 

A juvenile charge can change the direction of a child’s life—at school, at home, and in the community. Our firm represents children and families in Tennessee juvenile delinquency proceedings with a focus on accountability that protects education, mental-health needs, and long-term stability rather than punishment alone.

We approach delinquency cases as part of the child’s whole story. School services, trauma history, disabilities, and family circumstances often play a central role in the behavior that brought the child to court. Our job is to make sure those realities are understood before decisions are made about detention, probation, or placement.


A Child-Centered Defense

A juvenile case does not exist in isolation. Suspension at school can follow a court charge. Mental-health needs may be mistaken for defiance. Foster placements can be threatened by misunderstandings about behavior.

Early, informed advocacy can keep a juvenile case from derailing a child’s education, services, and permanency.


Conservatorships for Young Adults

As children with complex needs approach adulthood, families face questions about decision-making and safety. We represent families seeking conservatorships and also explore less‑restrictive alternatives such as powers of attorney and supported decision-making.

We connect conservatorship planning with transition IEP services so there are no gaps in medical care, education, or housing when a child becomes an adult.
